Why Mediation?

It is inevitable that people working in pressurised environments will have differences of opinion. Over time this can lead to deterioration in relationships that can affect the whole team and may impact on the wider workforce.

If not remedied, this can affect the business of the organisation and in a healthcare environment may post a risk to patients.

Human resources interventions such as grievance and disciplinary processes may exact a judgement on the situation but rarely, if ever, will they repair damaged relationships.

The most compelling reason for mediation is that is an effective and cost efficient way of dealing with disputes and conflict .

Independent mediation generally has an 80% chance of success. At the moment Problem Resolution Limited is running at a significantly higher percentage. While this can change at any time, we believe that this is because we have developed a process that works very well for engaging with professionals in the NHS.

The Role of the Mediator

A mediator is independent and neutral. We are not there to judge anyone... we are there to help participants to reach an agreed way forward. We are skilled facilitators who will help them to think creatively about the situation and help them to overcome deadlock. We coach the parties in how to negotiate with each other and we act as reality tester... testing their assumptions and positions.

We are experienced at mediating in a variety of areas including long standing disputes between colleagues and dysfunctional departments. For example: clinical departments, executive and non-executive colleagues, CCGs and commissioning boards, conduct cases, bullying and harassment claims, grievances, votes of no confidence and failures to agree. We also work with large departments using mediation principles to enable the parties to build better visions for the future.

Our experience includes working with the parties at the onset of a dispute, after an investigation has taken place or a Medical Royal College report has been received through to cases that are lodged with the High Court. We have also mediated between staff and patients.
